Contest Rules

1. Eligibility: This Contest is open only to those who sign up at PetitNordiqueBoutique.com and who are 18 years of age as of the date of entry. The Contest is only open to Ontario Residents, and is void where prohibited by law. Employees of Petit Nordique Boutique , its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Contest. The Contest is subject to all applicable federal, provincial, local laws and regulations, and is void where prohibited.
2. Agreement to Rules: By participating, the Contestant (“You”) agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Petit Nordique Boutique (Contest Sponsor) as final and binding as it relates to the content of this Contest.
3. Contest Period: The Contest starts on January 1, 2023 at 12:00AM ET and closes on December 31, 2023 at 11:59PM ET (the “Contest Period) All Entries must be received by 11:59 p.m. (ET) on December 31, 2023 (the "Contest Closing Date"). Within the Contest Period there will be a total of ten (10) monthly Contest Draw Periods (each a “Monthly Contest Draw Period”) and a Grand Prize Draw. For the purposes of this Contest a “month” is defined as beginning on the 1st day of the calendar month at 12:01:00 a.m. and ending on the last day of the calendar month at 11:59:59 p.m. (ET).
4. How to Enter: NO PURCHASE NECESSARY. All Entries must be received and recorded within the Contest Period. The Contest computer system (the “Contest Computer”) is used to govern all computer and time-related aspects of the Contest (including the date and time an Entry was received) and, among other things, is the official time-keeping device for the Contest. To be eligible ballots must be completed in full.

Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Petit Nordique Boutique.

5. Prizes: There is one(1) Grand Prize of a $1000 Petit Nordique gift card (Grand Prize) and ten (10) prizes of a $100 Petit Nordique gift card available to be won during the Contest Period, with one (1) $100 gift card awarded during each Monthly Contest Draw Period and a Grand Prize Draw (as described in Rule 6 below). The total number of monthly prizes available will diminish as prizes are awarded. Prize will be delivered by Petit Nordique Boutique at Bowmanville store front at mutually arranged time or alternate arrangements may be made. The prize must be accepted as awarded with no substitutions, exchanges, transfers or refunds of the prize whether in cash or otherwise. No other prize substitution shall be permitted except at Petit Nordique Boutique discretion. Acceptance of prize constitutes permission for Petit Nordique Boutique to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
6. Odds: The odds of winning depend on the total number of eligible entries received between January 1, 2023 and the Monthly Contest Draw Period.
7. Winner Selection and Notification:  All random draws will be made using an online contest application, under the supervision of Petit Nordique Boutique at 10:00am (ET) as follows:

One (1) Entry will be randomly selected on each of the above draw dates from among all entries received during the respective Monthly Draw Period. All non-selected entries will carry forward into future monthly draws. Odds of being selected to win a Prize depends on the total number of eligible Entries received each Monthly Draw Period. If for any reason whatsoever, no eligible Entries are received for a Monthly Draw Period the Prize or Prizes designated for that Monthly Draw Period will carry forward to the next Monthly Draw Period.

The selected entrant will be notified by phone and email by Petit Nordique Boutique within five (5) days following selection of entrant. Petit Nordique Boutique shall have no liability for entrant’s failure to receive notices due to spam, junk e-mail or other security settings or for entrant’s provision of incorrect or otherwise non-functioning contact information. If entrant cannot be contacted, is ineligible, fails to claim the prize within 10 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate entrant selected. Prior to being declared a winner each selected entrant, must complete and return the Petit Nordique's Declaration of Compliance and Release of Liability and Publicity Release Form (the “Form”) releasing the Petit Nordique, their respective parent, related and affiliated companies, advertising and promotional agencies, and all of their respective directors, officers, owners, partners, shareholders, employees, agents, representatives, successors and assigns (the “Releasees”) from any liability in connection with this Contest or the acceptance, possession, use or misuse of any Prize.  The potential winner must return this form by mail to Petit Nordique at 34 King St. W, Bowmanville, ON L1C 1R3 or email the form to hello@petitnordiqueboutique.com within 10 business days following the date that the selected entrant was first contacted by Petit Nordique.  In the event that a selected entrant cannot be contacted by telephone, fails to provide proof of eligibility (if requested), release documents, or other required documentation in a timely manner, fails to correctly answer the skill-testing question, or if the telephone number is not correct or other non-compliance with these Official Rules, then the selected entrant will be disqualified without any liability to Petit Nordique whatsoever (and the disqualified selected entrant will have no claim against Petit Nordique with respect to the Contest, or anything related to the Contest) and another entrant will be randomly selected from the remaining eligible entries (and subject to disqualification in the same manner) and the process above will be repeated until such time as all Prizes are awarded or until there are no more eligible entrants.

Receipt by Winner of the prize offered in this Contest is conditioned upon compliance with any and all federal, provincial, and local laws and regulations. To be eligible to win a prize, the selected entrants must first correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question.

8. Rights Granted by You: By entering this content (e.g., photo, video, text, etc.), You understand and agree that Petit Nordique Boutique, anyone acting on behalf of Petit Nordique Boutique, and Petit Nordique Boutique’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Contest, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes. without any further compensation, notice, review, or consent. You shall indemnify, defend, and hold harmless Petit Nordique Boutique from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Petit Nordique Boutique may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.
9. Terms & Conditions: Petit Nordique Boutique reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest should virus, bug, non-authorized human intervention, fraud, or other cause beyond Petit Nordique Boutique’s control corrupt or affect the administration, security, fairness, or proper conduct of the Contest. In such case, Petit Nordique Boutique may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Petit Nordique Boutique. Petit Nordique Boutique reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates these Terms & Conditions. Petit Nordique Boutique has the right, in its sole discretion, to maintain the integrity of the Contest, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Contest rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. Should such attempt be made, Petit Nordique Boutique reserves the right to seek damages to the fullest extent permitted by law.
10. Limitation of Liability: By entering, You agree to release and hold harmless Petit Nordique Boutique and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.
11. General: By entering the Contest, Entrants (i) acknowledge compliance with these Official Rules including all eligibility requirements, and (ii) agree to be bound by these Official Rules and by the decisions of the Petit Nordique, made in their sole discretion, which shall be final and binding in all matters relating to this Contest. Entrants who have not complied with these Official Rules are subject to disqualification. Contest is subject to all applicable federal, provincial and municipal laws. Void where prohibited. Petit Nordique reserves the right to correct any typographical, printing, computer programming or operator errors. Petit Nordique’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, then the Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. Petit Nordique reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process, the operation of the Contest and/or Contest Website, violates the Official Contest Rules, or acts with intent to annoy, abuse, threaten or harass any other person. WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS CONTEST OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND Petit Nordique RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
12. Disputes: THIS CONTEST IS GOVERNED BY THE LAWS OF CANADA AND ONTARIO, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Contest, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in ONTARIO having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Contest). Participant further waives all rights to have damages multiplied or increased.
13. Privacy Policy: Petit Nordique and its authorized agents will collect, use and disclose the personal information you provide when you enter the Contest for the purposes of administering the Contest and Prize fulfillment. By entering this Contest, you consent to being contacted by Petit Nordique and its authorized agents about this Contest and your Entry.
14. Prize Sponsor: The Prize Sponsor of the Contest is Melanie Carnell, Sales Representative, C.S.T. Savings Inc., Branch 401.
